This article analyses from a theoretical point of view of the social construction of protest and
the framework analysis, the relevance of certain legal aspects in the construction of meanings that
enable the collective action in identity-base social movements. Starting from an interpretation of
their collective action in terms of the struggle for recognition, the article explains and analyses the
impact that the legislation Ley de Peligrosidad y Rehabilitación Social (1970) —Social Menace and
Rehabilitation Act— had in the rise of the gay movement in Spain.
